With the use of this website as well as the purchase of products on j-port.nl you confirm that these Terms and Conditions have been read, understood, and accepted by you. J-PORT B.V. may amend or simply update all or part of these Terms and Conditions. Therefore, you should regularly access this section on the website in order to check the publication of the most recent and updated Terms and Conditions of j-port.nl. The access to and use of j-port.nl, including the display of web pages, communication with J-PORT B.V., downloading product information, and making purchases on the website, are carried out by our users for personal purposes only. J-PORT B.V. is not liable for any use of the website and its contents made by its users that is not compliant with the laws and regulations in force, without prejudice to J-PORT B.V.'s liability for intentional torts and gross negligence.

In particular, you will be liable for communicating information or data which is not correct, false, or concerning third parties (in the event such third parties have not given their consent) as well as for any improper use of such data or information.

J-PORT B.V. shall have the exclusive right to authorize or prohibit in their sole discretion any reproduction, publication, distribution, display, modification, creation of derivative work from, or exploitation in any way of, in whole or in part, the Content. J-PORT B.V. shall have the right, at any time, to claim the authorship of any Content posted on this Site and to object to any use, distortion, or other modification of such Content.

Any reproduction, publication, distribution, display, modification, creation of derivative work from, or exploitation in any way of, the Content expressly authorized in writing by J-PORT B.V. shall be carried out by you for lawful purposes only and in compliance with all applicable laws.

When J-PORT B.V. provides links to other websites, J-PORT B.V. does not recommend that its users access these websites and it does not provide any guarantees to their web content or to services and products supplied and sold by these websites to Internet users.

J-PORT B.V. is entitled to object to certain links to its website for whatever at the sole discretion of J-PORT B.V. In any event, it is forbidden to post deep links (such as deep frames) to j-port.nl or to use unauthorized meta-tags without J-PORT B.V.’S consent.

4. Disclaimer on Content

J-PORT B.V. has adopted measures to ensure that the content of j-port.nl is accurate, does not contain any illegal, incorrect, or out-of-date information, and is in compliance with relevant legislation. However, J-PORT B.V. cannot be held liable for the accuracy and completeness of the content, except for its liability for tort and gross negligence and as otherwise provided for by the law.

Moreover, J-PORT B.V. cannot guarantee that the website will operate continuously, without any interruptions and errors due to the connection to the Internet. Please contact your Internet services J-PORT B.V. or check that each device for Internet connection and access to web content is correctly activated, including your Internet browser. The dynamic nature of the Internet and web content may not allow j-port.nl to operate without any suspensions, interruptions, or discontinuity due to updating the website. 6. Our Business Policy

6.1 J-PORT B.V. has adopted a business policy: its mission is selling products through its website to "businesses" only.

6.2 "Business" shall mean anyone who is acting for purposes, which are within his or her trade, business, or profession.

6.4 J-PORT B.V. reserves the right to not process orders received from all parties that do not comply with J-PORT's business policy.

6.5 These Terms and Conditions (together with the documents referred to herein) regulate the offer, transmission and acceptance of purchase orders relating to products on j-port.nl between the users of j-port.nl and J-PORT B.V.

6.6 The Terms and Conditions do not regulate the supply of services, or the sale of products performed by third parties that are on j-port.nl through links, banners or other hypertext links. Before sending orders and purchasing products and services from those third parties, J-PORT B.V. recommends that you verify the third party's terms and conditions, since J-PORT B.V. shall under no circumstances be deemed liable for the supply of services provided by third parties or for the execution of e-commerce transactions between the users of j-port.nl and third parties. 

7. How to place an order request with J-PORT B.V.

7.1 To place an order request for the purchase of one or more products on j-port.nl, you must fill out the online order form and send it to J-PORT B.V., following the relevant instructions.

7.2 The order request form contains information on the main characteristics of each product ordered and corresponding unit price (including all applicable fees and taxes), shipping terms for the purchased products, shipping, and delivery costs.

7.3 An order request shall be deemed to have been submitted, when J-PORT B.V. receives the order request through its website j-port.nl.

7.4 Before submitting your order form for the purchase of products, you will be asked to carefully read the Terms and Conditions.

7.5 The order request form will be filed in our database for the time required to process your order and as provided by law. You may access your order request form by logging in and visiting the section called Orders, in the My Account area. 

7.6 Before submitting the order request form, you will be asked to identify and correct possible input errors.

7.7 English is the language used for executing contracts with J-PORT B.V.

7.8 After your order request form has been submitted, J-PORT B.V. will first authorize, and then process your order request.

7.9 If any of the requested products are not in stock, the customer is notified of the unavailability of the product.

7.10 By submitting an order request to J-PORT B.V., you unconditionally accept and undertake to observe the provisions of these Terms and Conditions of Sale. Should you not agree with certain provisions of these Terms and Conditions of Sale, please do not request your order for the purchase of products on j-port.nl.

7.11 Upon submission of an order form request, J-PORT B.V. shall send you an invoice of the available products by e-mail.

8. Guarantees and Product Price

8.1 On j-port.nl, J-PORT B.V. offers top quality products that are checked and approved by j-port.nl.

8.2 The main characteristics of products are shown on j-port.nl on each product page. J-PORT B.V. has made every effort to display the colors of our products that appear on the J-PORT B.V.’s Online Store as accurately as possible. However, as computer monitors vary, J-PORT B.V. cannot guarantee that your monitor's display of any color will be completely accurate. All items are quality controlled and checked for any faults before they are dispatched to customers. Should you receive an item that is of insufficient condition please contact J-PORT B.V. immediately by e-mail at wholesale@j-port.nl.

8.3 Prices are ex VAT and are subject to change from time to time and will be as quoted on our site, except in cases of obvious error. Check the final price of sale before sending the relevant order form.

9. Payments

9.1 Payment of the product prices and relevant costs for shipping and delivery must be made by direct bank transfer as indicated on the invoice.

10. Shipping and Delivery of the Products

All orders are shipped after receipt of payment. Orders will only be delivered to the address you have stated when placing your order. J-PORT B.V. cannot be held responsible for any inaccurate addresses provided to us or for giving your authorization for goods to be left in a safe place with our courier. Providing the correct delivery address and picking up the shipment on time is the full responsibility of the consumer. J-PORT B.V. does not hold itself liable for any incorrect deliveries due to incorrect delivery address information or disposal of packages outside the European Union due to untimely collection of shipments.

Shipment within EU countries is free of import duties. For other countries import duties are applicable as required, and payable by the receiver of the order.

In very rare circumstances we may not be able to fulfill your order. Should we experience any problems with the availability of your order, we will let you know as soon as possible.

Whilst we will use all reasonable endeavors to meet the timescales of your delivery we may sometimes experience delays because of unforeseen circumstances beyond our control and we, therefore, cannot accept any liability for any delays or non-delivery.

We will not deliver to forwarding addresses or Post Office boxes due to the risk of fraud.

12. Dealing with breakage on delivery

12.1. At J-PORT B.V., we take great care in packaging and shipping your orders to ensure that they arrive in excellent condition. However, we understand that accidents can happen during transportation, and some items may arrive damaged.

If your items arrive damaged, please don't hesitate to contact us. You can send us a message with proof of the breakage, such as photos of the damaged items and packaging.

Once we have received your message and proof of breakage, we will send replacement items at no additional cost to you. We believe in providing excellent customer service and want to ensure that you are completely satisfied with your purchase from us.

Please note that it is important to report any damage as soon as possible, ideally within 48 hours of receiving your order. This will allow us to file a claim with the shipping carrier and resolve the issue quickly.

In addition to replacing damaged items, we will also work with you to ensure that the issue is resolved to your satisfaction. We value our customers and want to make sure that you have a positive experience when shopping with us.

14. Amendments and updates

The Terms and Conditions of Sale may be amended from time to time due to new laws and regulations or other reasons. The new Terms and Conditions of Sale shall be effective as of the date of publication on j-port.nl.

16. Valid Payment Methods

Payment for all goods can be done via direct bank transfer. 

17. Liability

17.1 As our products are often used in combination with (boiling) hot water, J-PORT B.V. would like to point out that you should be careful when using hot water to avoid injuries. Keep out of reach of children and animals. Please don’t use our products in the microwave, and don’t put them over direct fire to avoid injuries. 

17.2 Subject to Section 7.1 above, other than as expressly provided in these terms and conditions with respect to specific products and except for the exclusive remedies set out at Section 5 above, any indemnities, warranties, terms and conditions (whether express or implied) are hereby excluded to the fullest extent permitted under applicable law.

17.3 Subject to 7.1 above, J-PORT B.V. will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent on negligent misrepresentations) or otherwise out of or in connection with the terms and conditions for any, economic losses (including without limitation loss of revenues, data, profits, contracts, business or anticipated savings); or loss of goodwill or reputation; or special or indirect losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under these terms and conditions.

17.4 Notwithstanding the above, subject to Section 7.1 our aggregate liability (whether in contract, tort or otherwise) for loss or damage shall in any event be limited to a sum equal to the amount paid or payable by you for the product(s) in respect of one incident or series of incidents attributable to the same clause.

17.5 The products sold on this site are provided for private domestic and consumer use only. Accordingly, J-PORT B.V. does not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of this site or for any products or services purchased from J-PORT.

18. Miscellaneous

18.1 These Terms supersede any and all other conditions, understandings, commitments, agreements or representations (except fraudulent misrepresentations) relating to your purchase, whether oral or in writing, and contain the entire agreement between J-PORT B.V. and you relating to your purchase.

18.2 No waiver by J-PORT B.V. of any breach of these terms and conditions shall be considered as a waiver of any subsequent breach of the same or any other position.

18.3 It is a criminal offence to use a false name or a known invalid credit card to order. Anyone caught willfully entering an erroneous or fictitious order will be reported to the relevant authorities.

18.4 To provide increased value to our customers, J-PORT B.V. may provide links to other websites or resources for you to access at your sole discretion. You acknowledge and agree that, as you have chosen to enter the linked website J-PORT B.V. is not responsible for the availability of such external websites or resources, and do not review or endorse and are not responsible or liable, directly or indirectly, for (i) the privacy practices of such websites, (ii) the content of such websites, including (without limitation) any advertising, content, products, goods or other materials or services on or available from such websites or resources or (iii) the use to which others make of these websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such advertising, content, products, goods or other materials or services available on such external websites or resources.

18.5 Regarding products sold outside of the European Union (EU), J-PORT B.V. will not have any responsibility whatsoever for any local tax, charges, and custom duties. If you refuse to pay local taxes, charges and custom duties and the products are returned to J-PORT B.V., J-PORT B.V. has the right to withhold from the refund both the initial delivery cost and the cost of repatriating the products, up to the value of the original delivery charge.

18.6 Where J-PORT B.V. takes payment for an order in Euro or other currency, J-PORT B.V. is not responsible for the exchange rate at which a bank charges its customer, or for any additional charges it makes. In addition, any refunds are made in the same currency that the order was placed and J-PORT B.V. is not responsible for the exchange rate at which a bank charges its customer, or for any additional charges it makes.

19. Governing Law

Dutch Law governs these Terms and Conditions.
